A state district judge ruled in favor of Egolf + Ferlic + Martinez + Cox, LLC client Top Organics-Ultra Heath, denying the five day closure ordered by the Department of Health. Judge Thompson wrote the imposed penalty was “one thousand times” more than allowed under the law and there was “scant [legal] support … for such a punitive fine.”
Top Organics-Ultra Health has a pending lawsuit against the Department of Health due to the lack approving medical cannabis producers which is creating an inadequate supply of medical cannabis for patients. The lawsuit is scheduled to begin in July. Egolf + Ferlic + Martinez + Cox, LLC’s Brian Egolf will be representing Top Orangics-Ultra Heath.
